A criminal complaint filed against Kinzy Evans, the intruder who was shot, stated that the boy's father, Vincent Guerra, was 'upstairs watching television' when he heard a noise downstairs and discovered Evans and an accomplice attempting to steal another television set. It was Guerra who reached for the AR-15, loaded it and shot Evans in the leg, the complaint said.
